Two examples that would constitute a violation of the NLRA would be a hospital that transfers or lays off an employee or otherwise punishes the employee by making them work more difficult tasks because the employee engaged in union or protected activities. These examples are predicated upon the notion that the employee was engaging in behavior that is protected by the NLRA and after an investigation by the NLRB, a declaration would be made as to whether the hospital violated the rights of the employee by violating NLRA. An example would be hospital workers that go on strike to protest unsafe working conditions. The hospital then places the workers on tougher details after the strike that makes them more susceptible to dangerous conditions in an attempt to punish them for exercising their right to strike. The hospital could relocate the workers or limit their hours in an attempt to intimidate the workers.
